We are writing to advise you of a recent amendment to the Taylor Law that is now in effect giving employee organizations (unions) the right to attend new employee orientations.
A public employer (including a school district) must now provide certified and recognized employee organizations with not less than 10 days’ advance notice of a new employee orientation. An employer can provide less than 10 days’ notice if there is an “urgent need critical to the employer’s operations” that the employer did not reasonably foresee more than 10 days before the orientation.
If a union requests to attend a new employee orientation, the employer must grant that request. The law provides that “the structure, time and manner of exclusive representative access” is to be negotiated between the employer and union.
