Repeal of Requirement to Report on COVID-19 Vaccinations and In-Person Student Instruction

We are writing to advise you of the repeal of Governor Cuomo’s Executive Order 202.95 regarding mandatory reporting of in-person student instruction and COVID-19 vaccinations by P-12 public and non-public schools, school districts and teachers. On Friday, February 26, 2021, Governor Cuomo, through Executive Order 202.96,[*] repealed these reporting mandates. As a result, reporting of in-person student instruction and COVID-19 vaccinations by schools, school districts and teachers is no longer required. Executive Order 202.96 now mandates that, upon request, every local health department report the number of vaccinated teachers and other school staff members to the State Department of Health.
