February 12, 2020 New Form I-9
KEEPING YOU INFORMED…
We are writing to advise you that, effective May 1, 2020, employers must use the new Form I-9, Employment Eligibility Verification (version 10/21/2019) issued by the Department of Homeland Security (DHS). Employers may start using the new version now and can only use the prior version (version 07/17/2017) until April 30, 2020. The version date is located in the lower left corner of the form.
The new form revised the Country of Issuance field in Section 1 and the Issuing Authority field (when selecting a foreign passport) in Section 2 to add Eswatini and Macedonia, North to reflect those countries’ recent name changes (these changes are only visible when completing the electronic version of the form).
The revised Form I-9 instructions: (a) clarify who can act as an authorized employer representative; (b) clarify the acceptable documents for the form; (c) update the process for requesting paper forms; and (d) update the DHS Privacy Notice.
Links to the new Form I-9 in both electronic and paper form, as well as links to the revised instructions and a form translated in Spanish, are available at: https://www.uscis.gov/i-9. The Spanish version of the Form I-9 can only be used in Puerto Rico. Other employers and employees may print the Spanish version for reference, but must complete the form in English to meet employment eligibility verification requirements.
If you have questions regarding the new Form I-9, please contact Lauren Schnitzer or one of our other attorneys by calling (631) 694-2300.
