Minimum Wage Increase

Minimum Wage Increase

KEEPING YOU INFORMED…

We are writing to remind you that, effective December 31, 2021, the New York State minimum wage rate will increase as follows: the minimum wage rate for Long Island and Westchester will increase to $15.00/hour (matching the rate in New York City, which will remain at $15.00/hour) and the minimum wage rate for the remainder of the State will increase to $13.20/hour (except, covered fast food industry workers throughout the State will maintain their current $15.00/hour wage rate).[1]

The minimum wage requirements apply to private sector employers (with exceptions for certain types of employees) and to employers of individuals employed or permitted to work in any non-teaching capacity by a school district or BOCES.

Covered employers must display, in plain view at the workplace, the poster available at: https://dol.ny.gov/system/files/documents/2021/12/ls207.pdf. Employers in the apparel, building service, farm or hospitality (including fast food) industries, however, must display the poster that is applicable to their businesses (available at: https://www.ny.gov/new-york-states-minimum-wage/new-york-states-minimum-wage).

If you have any questions regarding the State’s minimum wage rates or determining which requirements apply to your workplace, please contact Lauren Schnitzer or one of our other attorneys by calling 631-694-2300.
