We are writing to inform you about a recent change to the New York State Executive Law that became effective on February 24, 2019 affecting employee rights.
The Gender Expression Nondiscrimination Act (GENDA) amends the so-called Human Rights Law to prohibit discrimination based on gender identity or expression by employers with four or more employees, employment agencies, labor organizations or licensing agencies. The law defines gender identity or expression as “a person’s actual or perceived gender-related identity, appearance, behavior, expression, or other gender-related characteristic regardless of the sex assigned to that person at birth, including, but not limited to, the status of being transgender.”
This new law may require you to modify your existing anti-discrimination policies or provisions in your employee handbooks.
