Client Memo re NY HERO Act Plans

As a follow up to our February 18, 2022 client memorandum, we are writing to advise you that private sector employers are no longer required to implement their NY HERO Act (New York Health and Essential Rights Act) plans at this time.

The State’s HERO Act website (https://dol.ny.gov/ny-hero-act) has published the following statement notifying the public of this change: “On March 17, 2022, the designation of COVID-19 as an airborne infectious disease that presents a serious risk of harm to the public health under the HERO Act ended.” Thus, private sector employers are no longer required to implement their NY HERO Act plans.

As always, we will keep you apprised if, given the cyclical nature of COVID-19, a new designation is made requiring the re-implementation of these plans at a future date.
