June 13, 2014 Audit Committee Members and Oath of Office

With school district reorganization meetings right around the corner, we write to provide guidance regarding the appointment of Audit Committee members.
The Board of Education should appoint all members of the Audit Committee at the reorganization meeting. This can be accomplished by adopting the following resolution:
BE IT RESOLVED, upon the recommendation of the Superintendent of Schools, the following members are appointed to the District’s 2014-2015 Audit Committee: _________________________.
Public Officers Law § 10 requires that all school district officers take an oath of office. The Education Law provides that Audit Committee members are considered to be school district officers for indemnification purposes. It is unclear whether the Audit Committee members are considered officers for other purposes, so we recommend that the oath of office be administered to them.
