In our March 12, 2012 Client Memo, we set forth the highlights of an agreement to modify the APPR law (Education Law §3012-c) and the legislation drafted to effect those changes. The legislation was recently passed and the Board of Regents adopted new regulations to implement these statutory revisions. This memorandum is to advise you that the State Education Department (“SED”) has issued a guidance document (“Guidance”) addressing the implementation of the newly amended APPR law.
